VESTING
- The following tenancy types are recognized: Tenancy in Common, Joint Tenancy, Tenancy by the Entirety
- The non-titled spouse must sign the security instrument irregardless if he/she holds title
- Acceptable instruments for transferring ownership on real property: Warranty Deed or Quitclaim Deed
- Warranty Deed or Quitclaim Deed must include grantor, grantee, consideration, address, property description, signature, and acknowledgement
RELEASE POWER OF ATTORNEY TAX DUE DATES
- First Installment is due on August 1st or November 1st if collected semi-annually
- Second Installment is due on November 1st or May 1st if collected semi-annually
- Property taxes may be collected quarterly installments due on: February 1st, May 1st, August 1st and November 1st
MORTGAGE/TRANSFER TAX
- Mortgage tax is NOT charged
- Transfer tax fees are $2.28 per $500.00 except in Barnstable, Duke and Nantucket which require additional county stamp tax or land bank fees
SECURITY INSTRUMENT RECORDING REQUIREMENTS
- All original signatures must have names typed or printed under signature line
- Notaries stamp or seal must be on all instruments submitted for recording
- Corporate seal is not necessary, however recommended
- The name and address of the person preparing the instrument is not required
- The address of each party is required on all documents submitted for recording
WHO MAY SERVE AS TRUSTEE ON DEED OF TRUST STATUTE OF LIMITATIONS
- JUDGMENTS IN FAVOR OF U.S. - 20 years
- ALL OTHER JUDGMENTS - 20 years
- STATE OF MASSACHUSETTS TAX LIENS - 10 years
- FEDERAL TAX LIENS - 10 years
- FINANCING STATEMENT - 5 years
- WRIT OF ATTACHMENT - 6 years
