VESTING                     
  • The following tenancy types are recognized: Tenancy in Common and Joint Tenancy                                    
  • The non-titled spouse must sign the security instrument irregardless if he/she holds title                                    
  • In the event of death of the spouse the property will revert to the surviving spouse as long as vesting was held as husband and wife as joint tenants with right of survivorship. A death certificate must be recorded.                                    
  • Acceptable instruments for transferring ownership on real property: Warranty Deed, Limited Warranty Deed, Special Warranty Deed or Quit Claim Deed. Any deed must include a mail tax statement to address which should be the grantee name and address.                                    
                                       
RELEASE                           
  • Acceptable instruments to release mortgages: Release of Mortgage/lien or Satisfaction                                    
                                       
POWER OF ATTORNEY                 
  • Power of attorney must be durable, acknowledge and must be recorded with the security instrument                                    
                                       
TAX DUE DATES            
  • Taxes are due and payable on October 1 and become delinquent on January 1                                    
  • Tax checks should be made payable to the Revenue Commissioner of the county or taxing authority                                    
                                       
MORTGAGE/TRANSFER TAX                         
  • Deed transfer tax is $0.50 per $500.00 and must be payable to the Probate judge.                                    
  • Mortgage tax is $0.15 per $100.00.                                    
                                       
SECURITY INSTRUMENT RECORDING REQUIREMENTS            
  • Marital status of all persons on instrument must be disclosed on first page                                    
  • All original signatures must have names typed or printed under signature line                                    
  • Notarization must include signature with name typed or printed under signature line, date of expiration of commission and seal or stamp. If notary is from Alabama a seal is not required.                                     
  • Document must include the prepared by with the name, title and address of the individual. Include a return to name and address.         
  • A derivation clause is required on the legal description to the property.
